In view of the proposed order being passed, notices to respondent No.6 is dispensed with. Heard learned counsel for the petitioner and learned Standing Counsel for respondent nos.1 to 5. By this petition, the petitioner has prayed for the following relief:- "a. Issue any writ order or direction in the nature of mandamus direct the opposite party no. 4 & 5 to stop the disbursement of the family pension being received by the opposite party no. 6 and conduct the enquiry in the matter in the interest of justice. b. Issue any writ order or direction in the nature of mandamus direct to the opposite party no. 2 to 4 to initiate recovery proceedings against opposite party no. 6 as she is receiving the family pension fraudulently in the interest of justice." After arguing for sometime, learned counsel for the petitioner confines his prayer to the extent that the representation of the petitioner may be directed to be decided by respondent no.4. Learned Standing Counsel has no objection to this innocuous prayer. Perused the record. Considering the above, the petition is disposed of with liberty to the petitioner to move a fresh representation to respondent no.4 i.e. Executive Engineer, Public Works Department, Raebareli within two weeks' from today. If the petitioner submits a fresh representation, the respondent no.4 shall decide the same within four weeks' thereafter, by passing a speaking and reasoned order.
