The learned counsel for the petitioner would submit that the petitioner entrusted 30 sovereigns gold jewels and Rs.12,00,000/- cash to the fourth respondent for the business purpose. Without knowledge of the petitioner, the fourth respondent pledged the jewels in his favour in his father’s bank and thereafter, again pledged the said jewels before another bank in his name. Thereafter, when the petitioner asked the fourth respondent to return the jewels, he failed to return the same. Therefore, he lodged the complaint as against the fourth respondent before the third respondent on 04.12.2024 and thereafter, they issued summons on _____________ Page No. 2 of 5 https://www.mhc.tn.gov.in/judis W.P(MD) NO.10827 of 2025 05.12.2024, but no action was taken. Therefore, he filed this petition. 3. The learned Additional Public Prosecutor (Crl.Side) for the respondents 1 to 3 would submit that the petitioner lodged a complaint before the third respondent on 04.12.2024 and they also issued summons to the fourth respondent and the enquiry is pending and they will conduct enquiry and take appropriate action in accordance with law. 4. Considering the prayer sought for in this petition, this Court, without issuing notice to the fourth respondent, is inclined to pass orders. 5. According to the petitioner, the fourth respondent obtained the jewels and money from the petitioner and the same were misappropriated , thereby, the petitioner lodged a complaint before the third respondent dated 04.12.2024, but no action was taken. According to the third respondent, after receipt of the complaint, they issued summons to the fourth respondent and the same is under enquiry.
