Learned Additional Chief Standing Counsel has raised a preliminary objections regarding maintainability of the instant petition at the behest of the petitioner Society in respect of which it is stated that the Society was wound up in the year 1996 and is still under the control of liquidator. However, the instant petition, the petitioner Society has been sued through ex- Chairman which is not permissible. Learned counsel for the petitioner, after arguing at some length, submits that he may be permitted to withdraw the petition with liberty to file a fresh with necessary and appropriate documents. In view of the aforesaid, the petition is dismissed as withdrawn with liberty as aforesaid.
