WPCRL No.1387 of 2024 Hon’ble Pankaj Purohit, J.
Mr. Sachin Veer Singh and Mr. Manoj Bhatt, learned counsel for the petitioner.
2. Ms. Rangoli Purohit, learned Brief Holder for the State.
3. This writ petition has been filed by the petitioner under Article 226 of the Constitution of India for expediting the proceedings of Criminal Case No.62 of 2020, State vs. Mohd. Julfikar and others.
4. It was contended by the learned counsel for the petitioner earlier that the trial is not proceeding at all in the matter, on which, the Court has directed to State to seek instructions with regard to progress of the trial vide its order dated 21.04.2025.
5. Today, on instructions, it is submitted by the learned counsel appearing for the State that the trial is in progress, but still, for the appearance of the accused, the next date is fixed on 20.06.2025.
6. It is contended by the learned counsel for the petitioner that the cognizance was taken and the accused was summoned by the learned trial court on 22.01.2020, [against the accused person], but till date, after lapse of five years, none the accused persons except Mohd. Julfikar, have put in appearance before the trial court. He further contended that the speedy trial is the right of petitioner under the Constitution of India.
7. I have perused the writ petition and the order-sheet annexed with the writ petition.
8. This is a very sorry state of affairs on seeing the order-sheet and the instructions received by the State, even no adequate attempt appears to have been made by the learned trial court to ensure the appearance of the accused persons to put them to trial.
9. In view of the above, the writ petition is allowed. The learned trial court is directed to expedite the trial and conclude it expeditiously within a period of two years from the date of production of certified copy of this order.
