Neutral Citation No. - 2025:AHC-LKO:38369 Court No. - 18 Case :- WRIT - A No. - 5286 of 2003 Petitioner :- Rajesh Singh Respondent :- State Of U.P.Through Prin Secy Land Devlop. And 1 Ors Counsel for Petitioner :- Smt.B.Godiyal,Atulesh Kr. Singh,Pradeep Kumar Srivastava Counsel for Respondent :- C.S.C.,B.R. Singh,Rajendra Singh Chauhan Hon'ble Manish Mathur,J. 1. Heard learned counsel for petitioner, learned State Counsel for opposite party no.1 and Mr. Rajendra Singh Chauhan, learned counsel for opposite party no.2. 2. Petition has been filed seeking a direction to opposite party no.2 to provide suitable employment to petitioner on compassionate basis in terms of Dying in Harness Rules which were applicable. 3. From a perusal of material on record, particularly the supplementary counter affidavit dated 13/22.01.2021, it appears that the Mandaliya Vikas Nigam under which petitioner's late father was employed was closed by the State Government vide Order dated 07.11.1992 but petitioner's father who was retrenched was posted for security of Dal Mill which was undergoing closure procedure. Father of petitioner subsequently passed away on 29.11.2000. 4. It thus appears that the Corporation whereunder compassionate appointment is being sought no longer exists due to winding up vide order dated on 07.11.1992 and therefore there is no occasion to issue any directions for compassionate appointment of petitioner since the employer itself has ceased to exit. 5. In view of aforesaid, the petition fails and is dismissed. Parties to bearing their own costs.
