ORDER 14-08-2025
1. The petitioner herein, besides other reliefs, has sought a writ of mandamus commanding the respondents to remove the encroachment, which presently exists in the form of tin sheets and iron, on the State/UT land measuring about 12 kanals under Khasra Nos. 606, 608, 611/1/607 situated at Madbagh, Nowshera, Srinagar, earmarked for construction of a marriage hall and children’s park.
2. It is stated that the said land is being used by the petitioner for ingress and egress to approach his residential house. It is further alleged that the land has been subjected to repeated attempts of encroachment by land grabbers/mafias, owing to the failure of the respondents to discharge their duties from time to time.
3. It is also stated that various representations were submitted by the petitioner seeking removal of the encroachment on the said land, but the respondents have failed to take any action thereon.
4. Learned counsel for the petitioner submits that the petitioner would feel satisfied, if the present petition is disposed of with a direction to respondents 2 to 4 to decide the representations of the petitioner, placed on record as Annexure-V, within a reasonable time.
5. Ms. Nadiya, learned Assisting Counsel vice Mr. Mohsin Ul Showkat Qadri, learned Sr. AAG, submits that she is not averse to the disposal of the writ petition in the manner prayed for by the learned counsel for the petitioner.
6. Accordingly, with the consent of learned counsel for the parties, the present petition is disposed of with a direction to respondents 2 to 4 to consider and decide the petitioner’s representation, placed on record as Annexure-V, and take action thereon strictly in accordance with law and rules, within a period of four weeks from the date a copy of this order is served upon them.
7. Disposed of in the above terms.
