Heard Mr. H. R. Choudhury, learned counsel for the petitioner. Also heard Mr. K. K. Parasar, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of Karimganj. P. S. Case No.179/2025. 3. The allegation brought against the petitioner is that though for contesting election in the Panchayat the candidate has to be 21 years old but in spite of below 21 Page No.# 2/2 years of age, the petitioner had projected herself to be more than 21 years of age. 4. Learned counsel for the petitioner has submitted that the petitioner is a newly married girl and her relatives and her matrimonial house had arraigned everything by preparing documents showing her to be more than 21 years of age. 5. I have considered the submissions made by learned counsel for both the sides. 6. Under the given circumstanced, this Court is of the opinion that the petitioner being a woman do not deserve to be detained in custody for the allegation brought against her. 7. Therefore, her pre-arrest bail application is allowed. 8. It is hereby directed that in the event of arrest in connection with Karimganj. P. S. Case No.179/2025, the petitioner, Ruhina Parbin shall be released on bail of Rs.20,000/- with a surety of like amount to the satisfaction of the arresting authority. 9. The petitioner shall co-operate with the Police Investigating Officer as and when called for. 10. With the aforesaid direction, the present bail application stands disposed of.
