By means of this petition filed under Article 226 of the Constitution, petitioners want expeditious disposal of the pending rent case no. 349 of 2023 before Additional District Magistrate (Civil Supplies), Kanpur Nagar. It is submitted that even after service of summons opposite parties did not appear and the Prescribed Authority proceeded for substituted service through publication and even after gazette publication, none appeared. It is next submitted that on 24.12.2024 hearing had finally taken place and case was reserved for orders fixing 06.01.2025 but instead of pronouncing any final order, the Prescribed Authority fixed further dates. Now today is again the date is fixed before the Prescribed Authority. In view of the above, this petition stands disposed of with a direction to the rent authority that in the event the publication of notice had taken place in a scheduled newspaper of the Judgeship of Kanpur, the Prescribed Authority shall proceed to finally decide the matter within a period of one month of production of certified copy of this order. However, in the event the publication has not taken place in any scheduled newspaper of Judgeship of Kanpur, the endeavour of the authority would be to get it published in a scheduled newspaper within 30 days of production of certified copy of this order and thereafter, shall proceed to record satisfaction regarding service of summons and decide the matter finally within statutory period prescribed under Section 33(7) of the Uttar Pradesh Regulation of Urban Premises Tenancy Act, 2021.
