Neutral Citation No. - 2025:AHC:32497 Court No. - 5 Case :- WRIT - A No. - 1300 of 2025 Petitioner :- Veer Singh Tyagi Respondent :- State Of Uttar Pradesh And 3 Others Counsel for Petitioner :- Amar Nath Vishwakarma Counsel for Respondent :- C.S.C.,Dhananjay Awasthi Hon'ble Ajay Bhanot,J. Heard Shri Shyam Kumar Yadav holding brief of Sri Amar Nath Vishwakarma, learned counsel for the petitioner, Shri Dhananjay Awasthi, learned counsel for the respondents and learned Standing Counsel for the State. The petitioner claims for payment of arrears of salary since 25.06.2020 to 09.02.2021. He has also moved several applications before the respondents in this regard but to no avail. Learned counsel for the respondents and learned Standing Counsel for the State submit that the matter requires factual determination as per applicable law by the competent authority in the first instance. However, they fairly contend that the claims regarding payment of arrears of salary are liable to be decided by the competent authority in a reasonable time frame. In light of the submissions made at the Bar and without going into the merits of the case, the respondent no. 3 is directed to decide the applications of the petitioner for payment of arrears of salary since 25.06.2020 to 09.02.2021 as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the application. The petitioner shall not be entitled to interest on the amount due to the delay on his part in approaching the Court. With the aforesaid direction, the writ petition is finally disposed of.
