Pleader for R1 Mr.S.Packiamuthu for R2 1/4 https://www.mhc.tn.gov.in/judis W.P.(MD).No.10628 of 2025 ORDER This writ petition has been filed challenging the impugned order / communication passed by the 2nd respondent vide Na.Ka.No. 1186/2021/H1 dated 06.03.2025 and also to direct the respondent to take necessary steps to construct the proper drainage channel to let the drainage outside of the village. 2. By consent of both parties, this writ petition is disposed at the stage of admission itself. 3. The case of the petitioner is that he is an agriculturalist. The second respondent has put up drainage system for the people living in the petitioner village, which collects all the wastes from the village and drains only into the petitioner's property, which spoils the crops in the petitioner's field and also spreads diseases to the people working in the field. Hence, the petitioner made a representation to the respondents to take necessary action for the same and the petitioner also filed a writ petition before this Court in WP(MD)No. 9272 of 2017 and the same was allowed. Pursuant to the same, the representation was considered and a notice dated 06.03.2025 has been issued 2/4 https://www.mhc.tn.gov.in/judis W.P.(MD).No.10628 of 2025 by the second respondent. Challenging the same, this writ petition has been filed. 4. On perusal of the materials available on record, it is seen that the order impugned in this writ petition is only a notice communicating that the village people should make a soakpit for their individual houses and hence, this writ petition itself is not maintainable and the same is dismissed.
