Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as accused in S.C.NDPS No.23 of 2024 on the file of the Court of the I Additional District & Sessions Judge, Vizianagaram, for the alleged offence under Sections 8(c) read with 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. The learned counsel further submits that the petitioner has been arraigned as accused on the alleged confession of the child in conflict with law. 4. After going through the charge sheet, this Court is of the considered opinion that the competent Sessions Court must deal with the issue during the trial, as several facts need to be tested before the trial court. 5. With these observations, the criminal petition is disposed off, leaving it open to the petitioner to take all these grounds before the Sessions Court. 6.
