Heard learned counsel for the petitioner and learned Standing counsel for respondents. By this petition, the petitioner seeks following prayers:-
"i) Issue a writ, order or direction in the nature of MANDAMUS thereby commanding and directing the Opposite Parties to provide the pension alongwith all consequential benefits after including adding the Service rendered by the petitioners under the capacity of Daily Wager as qualifying service in terms of Government order dated 05.03.2021, the Uttar Pradesh Qualifying Service for Pension and Validation Act 2021. ii) Issue a writ, order or direction in the nature of MANDAMUS thereby commanding and directing the Opposite Parties to consider the services of work of petitioners in regard to pay scale ACP and all consequential benefits in the light of judgment of Hon'ble Supreme Court order dated 02.09.2019, passed in Civil Appeal No. 6789/2019, 'Prem Singh Vs State of U.P. & others" After arguing for some time, learned counsel for the petitioner submits that it would be suffice if respondent no. 6 is directed to decide the representation submitted by the petitioner, contained in Annexure No. 1 to the petition, in a stipulated period. Learned Standing Counsel has no objection to this innocuous prayer. Considering the above, the petitioner is directed to submit a representation before respondent no. 6 within two weeks from today and in case, such a representation is submitted, the same shall be decided by respondent no. 6 within a further period of four weeks by passing a reasoned and speaking order. With these observations, the petition stands disposed of. Order Date :- 15.4.2025/R.C. Digitally signed by :- RAM CHANDER YADAV High Court of Judicature at Allahabad, Lucknow Bench
