Hon'ble Om Prakash Shukla,J. Heard. The petitioner wants certain information which are in the form of statements recorded by the Police during investigation. The charge sheet has already been filed in Court. The Commission has found that such information cannot be given to the petitioner and has accepted the report of the Sub- Inspector in this regard. We are also of the opinion that if the petitioner is an accused in a criminal case in which charge sheet has been filed, therefore, the documents such as the one demanded cannot be provided to the petitioner by the Information Commission under the Right to Information Act, as the same would be provided at the appropriate stage of trial. In this regard, we have perused Section 230 of B.N.S.S., 2023 which refers to supplying to the accused, a copy of police report and other documents, in a case where the proceedings have been instituted on a police report, as in this case. Prior to the said stage, such information cannot be furnished to the accused. We, therefore, see no reason to interfere in the matter and the same is accordingly dismissed, without prejudice to the rights of the petitioner to assert his rights before the trial Court, at the appropriate stage.
