Heard learned counsel for the petitioner and perused the record. 2. The present petition has been filed by the petitioner with the following prayer: "(i) Direct the Additional Principal Judge, Court No. 3, Family Court, Lucknow to decide/dispose of the Case No. 4005 of 2023, Vishal Singh Vs. Deji Singh, under Section 13 of the Hindu Marriage Act pending in the Court of Additional Principal Judge, Court No. 3, Family Court, Lucknow within a period as fixed by this Hon'ble Court, in the interest of justice." 3. It is argued by the counsel for the petitioner that the respondent side has filed his Vakalatnama but is not cooperating with the conclusion of the proceedings. 4. Considering the said fact, the present petition is disposed of holding that in case, the respondent does not cooperate, the Family Court would be at liberty to decide the case exparte. It is further clarified that no unnecessary adjournment shall be granted to the respondent. Efforts shall be made by the Family Court to decide the suit expeditiously.
