02/28.07.2025 Heard Mr. Nagmani Tiwari, learned counsel for the petitioner and Mrs. Priya Shrestha, learned Spl.P.P assisted by Mr. Md. Ayub Ansari, learned counsel appearing for the informant.
The prayer for bail of the petitioner was earlier rejected in B.A. No.9388 of 2023.
Submission has been advanced by learned counsel for the petitioner that he is in custody since 10.05.2023. It has further been submitted that out of 12 charge sheet witnesses, only one witness has been examined so far. Learned counsel submits that the petitioner had not inflicted any dagger blow upon the person of the deceased and he is said to have caught hold of the deceased while the main assailants had committed the murder.
Learned Spl.P.P as well as learned counsel appearing for the informant have opposed the prayer for bail of the petitioner.
Regard being had to the fact that the petitioner had merely caught hold of the deceased and was not directly responsible for giving a dagger blow which resulted to his death, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand only) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-IX, Giridih in connection with Giridih (T) P.S. Case No.140 of 2019.
