GP FOR ENERGY The Court made the following ORDER: Heard Sri C.Subodh, learned counsel for the petitioner and Smt.Adarshita, learned counsel appeared for respondents 2 to 4. 2. The above writ petition is filed to declare the action of respondents, in providing power connection to the petitioner’s building constructed in Sy.No.498/1C and 498/2C of Adivi Village, Bapatla Mandal & District, in pursuance of application No.CPNCO12308091226 dated 27.06.2023, as illegal and arbitrary. 2 3. Learned counsel for the petitioner would submit that the petitioner purchased land to an extent of Ac.10-36 cents in Sy.No.498/1C, 498/2 and 498/2C in Adavi village, Bapatla Mandal and District under registered sale deed dated 26.03.2008. Out of the total extent, the petitioner gifted an extent of Ac.0-05 cents in Sy.No.498/1C, 498/2C by virtue of registered Gift Deed dated 25.10.2008 to one Burla Murali Krishna, his younger brother. The petitioner, after obtaining building permission from the Gram Panchayat vide proceedings Bc.No.6/2022-23, dated 10.05.2022, Bc.No.7/2022-23, dated 11.05.2022 constructed buildings in Sy.Nos.498/1C and 498/2C and thereafter applied for power connection vide application No.CPNCO12308091226. However, the service connection was not released. 4. The writ petition was listed on 02.04.2025, and adjourned at the request of learned junior standing counsel to get instructions. 5. Today, when the matter is taken up, Smt.Adarshita, learned counsel would submit that the application made by the petitioner vide Ex.P.1 is not available in the office of the respondents 3 to 5. Learned counsel would submit that if the petitioner makes a fresh application, the same will be considered as per the terms and conditions of Supply of Distribution and Retail Supply Licensees. 6. In reply, learned counsel for the petitioner would submit that the petitioner will make a fresh application in two weeks. 7. Given the facts and circumstances, without going into merits of the matter, the writ petition is disposed of at the admission stage with the consent of learned counsel on either side giving liberty to the petitioner to make a fresh application in two weeks. Upon making such an application, the respondents 3 to 5 shall consider the said application and pass appropriate orders strictly as 3 per the General Terms and Conditions of Supply or any other Rules in vogue as expeditiously as possible within three weeks thereafter. No order as to costs.
