A preliminary objection has been raised by the learned A.G.A. that the present Application U/S 482 Cr.P.C. is not maintainable inasmuch as the applicant has assailed the order dated 06.01.2024 passed by the Commercial Court No.01, Lucknow in Suit No. 84 of 2023 whereby the Commercial Court has closed the opportunity to file written statement as well as order dated 31.01.2025 rejecting the recall application. 2. On the aforesaid objection, learned counsel for the applicant submits that the present Application U/S 482 Cr.P.C. may be dismissed with liberty to the applicant to take appropriate remedy available against the impugned order passed by the Commercial Court. 3. Accordingly, the present Application U/S 482 Cr.P.C. is dismissed with the aforesaid liberty.
