Heard learned counsel for the petitioner(s) and learned Standing Counsel who has accepted notice on behalf of respondents 1 to 4. Learned standing counsel, on the basis of written instructions, which are taken on record, submits that the income certificate produced by the petitioner was of the year 2022 whereas as per Clause-3 of Government Order dated 21.3.2023, the income certificate ought to have been issued within six months from the date of advertisement. Thus, the income certificate given by the petitioner was not valid according to the advertisement and the aforesaid Government Order. Further, since no valid eligible widow candidate was available, therefore, the seat has been filled up by a BPL candidate, strictly on the basis of merit. In view of the above, the petition lacks merit and is accordingly dismissed.
