1. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor appearing for the State.
2. The learned counsel for the petitioners submits that the petitioners were arraigned as A.1 to A.5 in Crime No.31 of 2025 of Nandyal III Town Police Station, Nandyal District, registered for the alleged offence under Sections 406, 420, 465, 467, 468, 471, 474 read with 34 of the Indian Penal Code, 1860.
3. It is submitted that the 5th petitioner filed a suit in O.S. No.18 of 2019 before the III Additional District Court, Kurnool, at Nandyal. It is further stated that the allegation of forgery was not raised in the written statement filed in the pending suit. However, the allegation of forgery has come to light for the first time in the complaint, specifically regarding the forgery of a receipt dated 25.03.2013.
4. Considering the submissions, the Station House Officer, Nandyal III Town, Nandyal, is directed to complete the investigation in Crime No.31 of 2025 without taking coercive steps against the petitioners, duly considering their submissions regarding the alleged forgery. This order would not preclude the investigating officer from filing a charge sheet or final report upon completion of the investigation.
5. Accordingly, the criminal petition is disposed off.
