N CRIMINAL PETITION No.3458 OF 2025 ORDER: 1. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel for the petitioner submits that the petitioner is aggrieved by the order dated 19.05.2023, in Crl.M.P.No. 458 of 2023 in C.C. No. 6569 of 2019, on the file of the Court of the IV Additional Chief Metropolitan Magistrate-cum-Additional Mahila Magistrate, Vijayawada, rejecting the petition filed by the petitioner seeking permission to renew his passport. 3. The learned Magistrate dismissed the petition on the sole ground that another case is pending against the petitioner's husband. As such, the petitioner is disentitled to claim renewal of the passport. 4. The learned counsel for the petitioner submits that the husband of the petitioner filed W.P. No.18726 of 2024 seeking renewal of his passport, and this Court, by order dated 17.12.2024, allowed the writ petition and directed the 2nd respondent therein to renew his passport. The husband of the petitioner is also accused of the same crime. However, prior permission was required to be sought from the Court for travel. -3- CRL.P. No.3458 OF 2025 5. Considering the same, there shall be a direction to the concerned passport authority to renew the passport of the petitioner, if the application is otherwise in order. 6. With these observations, the criminal petition is allowed by setting aside the order, dated 19.05.2023 in Crl.M.P.No.458 of 2023 in C.C. No.6569 of 2019 passed by the IV Additional Chief Metropolitan Magistrate-cum-Additional Mahila Magistrate, Vijayawada. It is needless to mention that the petitioner shall obtain the necessary permission for traveling abroad from the concerned Magistrate. 7.
