(Petitioner In Sub Jail Ramganjmandi) ----Petitioner Versus The State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Ali Mohd. Khan For Respondent(s) : Mr. Vivek Choudhary, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN
Order 02/04/2025
1. The instant bail application has been filed under Section 483 of BNSS on behalf of the petitioner, who has been arrested in connection with FIR No.37/2023 registered at Police Station Modak, District Kota Rural (Rajasthan) for the offence punishable under Section 8/20 of NDPS Act.
2.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Counsel submits that petitioner has been made accused in this case solely on the basis of the fact that petitioner is registered owner of the vehicle in which alleged contraband was being carried by the co-accused persons. It is submitted that petitioner sold the said vehicle to one Panna Lal Nayak but on account of certain paper formalities, registration could not be transferred in his name. Counsel submits that it is evident from the record that an application was also filed
[2025:RJ-JP:14945] (2 of 3) [CRLMB-4274/2025] by the said Panna Lal Nayak for seeking interim custody of the vehicle and it has been stated by him in the said application that he purchased the said vehicle from the petitioner on 31.12.2022 and since then, he is owner of the vehicle and has possession of the same. Counsel submits that petitioner is female and she has a child who is aged about 2.5 months. Counsel submits that other co-accused persons who were not found in possession of the contraband have already been granted benefit of bail by this court as well as co-ordinate Bench of this Court. It is contended that there are no criminal antecedents against the petitioner and trial will take considerable time in its conclusion. Petitioner is in custody since 12.03.2025 and further custody of the petitioner would not serve any fruitful purpose. 3. Learned Public Prosecutor opposes the submissions made by counsel for the petitioner. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner as noted above, so also considering the fact that petitioner is a female and she is in custody with her child who is aged about 2.5 months and trial will take considerable time in its conclusion as well as looking to the fact that there are no criminal antecedents against the petitioner, but without commenting anything on the merits/demerits of the case, I deem it fit and proper to allow this bail application. 6.
6. This bail application is accordingly allowed and it is directed that accused-petitioner- Babli W/o Ramzan @ Kallu shall be
[2025:RJ-JP:14945] (3 of 3) [CRLMB-4274/2025] released on bail provided she furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned Trial Court with the stipulation that she shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 7. The observation made herein above is only for decision of the instant bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J LALIT MOHAN /267
