GP FOR REVENUE The Court made the following: THE HONOURABLE SRI JUSTICE VENKATESWARLU NIMMAGADDA WRIT PETITION NO:8355/2025 ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking following relief: “to issue any writ, order or Direction more particularly one in the nature of writ of Mandamus declaring the action of the 4th respondent in not considering the application vide No.NND20241215112, dt. 15.12.2024 for conducting survey and fix the boundaries to property to an extent of 133.65 Sq.m in Sy.No.242/1 of Giddaluru Village, Sanjamala Mandal, Nandyal District at the instance of respondent is illegal, arbitrary and violation of principles of natural justice and consequently direct the 4th respondent herein to conduct the survey in pursuance of the application dt.15.12.2024 forthwith and to pass such other order or orders….” 2. Heard learned counsel for the petitioner and learned Government Pleader for Revenue for the respondents. 3. Learned counsel for the petitioner submits that the petitioner herein is a land less poor person and eking out his livelihood by doing coolie works. While so, after thorough enquiry, respondent No.4 herein allotted a house site admeasuring to an extent of 133.65 Sq.m. in Sy.No.242/1 situated at Giddalur Village, Sanjamala Mandal, Nandyala District as a welfare measure under the house less category. Later, a possession certificate was also issued in his favour. While things stood thus, respondent No.5 along with his family members are interfering with the peaceful possession of the subject property of the petitioner and are trying to demolish the structures of the petitioner’s as if the petitioner herein encroached the property of respondent No.5. For which, the petitioner herein submitted an application 15.12.2024 to the respondent authorities requesting for conducting survey and to fix boundaries in respect of the subject property of the petitioner. Even after receipt of the said application, the respondents neither considered the same nor issued any proceedings. Hence, the writ petition. 4. On the other hand, learned Government Pleader for Revenue submits that in order to conduct survey and to fix boundaries in respect of the petitioner’s land, the petitioner herein has to make an appropriate F-line application to the respondent No.4 through Mee-seva or online by paying requisite fee. Due to the lack of proper F-line application, the petitioner’s land cannot be surveyed based on the representation submitted by the petitioner. He further submits that let there be a direction to the petitioner to submit a fresh F-line application for conducting survey and to fix boundaries in respect of the subject land through Mee-seva/ AP Online/ Village Secretariats by paying requisite fee. On receipt of such application, the respondents will consider the same, within a reasonable time. 5. Having regard to the submissions made by the learned counsel for the petitioner and learned Government Pleader for the respondents and on perusal of the material placed on record, this Court is of the considered view that the present writ petition can be disposed of, directing the petitioner to make an appropriate F-line application for conducting survey and to fix boundaries in respect of the subject land of the petitioner through MeeSeva/ AP Online/ Village Secretariat and on payment of requisite fee along with all the required documents, within a period of two (02) weeks from the date of receipt of a copy of this order. On receipt of such application, the respondents are hereby directed to conduct survey and fix boundaries in respect of the subject land of the petitioner, after serving notices and by providing opportunity to submit objections, if any, to all the parties concerned in compliance of the Andhra Pradesh Survey and Boundaries Act, 1923, within a period of two (02) months, thereafter. 6. With the above directions, the writ petition is disposed of. No costs.
