NELLORE DISTRICT, NELLORE ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ, Direction, Order or Orders more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not releasing the 2nd installment of financial assistance of Rs.5,00,000/- (Rupees Five Lakh only) to Ratakonda Himaja, the daughter of the Petitioner i.e., Ratakonda Nagaraja Rao, as per G.O.Rt.No. 174 dated 07.12.2017 r/w G.O.Ms.No. 29 dated 27.08.2016 despite sanction of funds by the Government under Application ID No.OV2018117468 dated 11.10.2018 and paid 1st Installment as illegal, arbitrary, violation of principles of natural justice and unconstitutional and consequently direct the respondents to release the financial assistance of 2nd Installment Rs.5,00,000/- (Rupees Five Lakhs only) to Ratakonda Himaja, the daughter of the Petitioner i.e., Ratakonda Nagaraja Rao, forthwith under Application ID No.OV2018117468 dated 11.10.2018 and to pass such other orders. The present Writ Petition is filed questioning the action of Respondent-authorities for not releasing the 2nd installment of financial assistance of Rs.5,00,000/- to the daughter of Petitioner as per G.O.Rt.No.174, Backward Classes Welfare (B) Department, dated 07.12.2017 R/w G.O.Ms.No.29, Backward Classes Welfare (B) Department, dated 27.08.2016 despite sanction of funds by the Government under Application ID.No.OV2018117468, dated 11.10.2018 and 1st installment of financial assistance of Rs.5,00,000/- and to declare the same as illegal and arbitrary. 2. The Petitioner’s daughter by name Ms. Ratakonda Himaja had applied for financial assistance of Rs.10,00,000/- under NTR Videshi Vidyadharana Scheme vide Application ID.No.OV2018117468, dated 11.10.2018 for pursuing Master of Engineering Management from Latrobe University Melbourne Campuses, Australia. The 1st installment amount of Rs.5,00,000/- was already released and as the 2nd installment amount of Rs.5,00,000/- was not being released, the present Writ Petition is filed. 4 3. The learned Government Pleader for Social Welfare appearing for the Respondents passed on the written instructions vide Lr.RC.No.60/EBC/2025, dated 04.12.2025 signed by the Managing Director of A.P. State Economically Backward Classes Welfare and Development Corporation, wherein it is stated that the student by name Ratakonda Himaja is eligible as per the report submitted by the Vigilance and Enforcement Department and sought for 3 months time for completion of the process for making payment. The relevant portion of the written instructions reads as under; “It is respectfully submitted that, in the V&E verification, it has been noticed that the student namely Ratakonda Himaja is eligible as per the report submitted by the Vigilance and Enforcement Department vide V & E report No.33 C.No.4576/V&E/Sec-II/D2/2021-5, dt.17.03.2023. In this regard, the Managing Director AP EBC Corporation has prepared a bill vide proceeding No.952/EBC-VVD/2024-4, dated 14-11-2024 to transfer the funds to the respective bank accounts each under “NTR Videshi Vidyadharana” Scheme, including the daughter of the Petitioner namely Ratakonda Himaja which was cited in S.No.1 vide Application ID.No.OV2018117468 by generating Bill No.2024-1763762 and bill was approved on 29.11.2024. Due to the yearend activity on 31.03.2025, the bill was closed by the Finance department and the payment status is being shown as “Bill returned to DDO as per Art.39 & 50 of AP Financial Code, Vol.I”. 5 4. As there is no dispute with regard to the claim of the daughter of the Petitioner, the Writ Petition is disposed of, with the following directions; (i) The Respondents are directed to disburse the due amount to the daughter of the Petitioner Ms. Ratakonda Himaja within a period of eight (8) weeks from the date of receipt of a copy of this order; (ii) There shall be no order as to costs. 5.
