Raj Kumar, Under order 7 Rule 1 of Civil Procedure Code, filled by the petitioner expeditiously as fixed by this Hon'ble Court, in the interest of justice." 3. It is informed that even Written Statement has not been filed. In such a situation, the petitioner has a remedy of moving an application under Order VIII Rule 10 CPC.
