GP FOR SERVICES II The Court made the following: ORDER: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:- “…to issue an appropriate order or directions more particularly one in the nature of Writ of Mandamus questioning the action of the 2nd respondent not promoting the petitioner post of Grade-ll Head Master as highly illegal arbitrary unjust and contrary to violation of Article 14 16 and 21 of the Constitution of India and consequentially direct the respondents to consider the petitioner claim for promotion to the post of Grade-ll Head Master and dispose off the petitioner representation dated 25.02.2025 and pass such other order or orders.…” 2. Heard Sri P.V.Ramana, learned counsel for the petitioners and learned Assistant Government Pleaders for Services-I appearing on behalf of the respondents. 3. The petitioner has been appointed as Grade-II Hindi Pandit in the year 1999 and subsequently got promoted as School Assistant in the year 2007. He is eligible and entitled to be considered for promotion to the post of Grade-II Head Master. Respondent No.4 by proceedings Memo.Rc.No.B2/647/2024 dated 22.07.2024 issued final seniority list in the cadre of School Assistants, in which petitioner has been placed at Serial No.17. As the petitioner falls within the zone of consideration for the purpose of promotion, he submitted representation dated 25.02.2025 to respondent No.4 for considering his case. 4. The grievance of the petitioner is that despite issuing final seniority list and petitioner making representation in that regard, respondents have not effected promotion so far. 5. Learned counsel for the petitioner submits that it would suffice to direct respondent No.4 to consider and pass orders disposing his representation. 6. Learned Assistant Government Pleader for Services-II submits that the petitioner has no right to be promoted but only has a right for consideration. However, his representation would be considered in accordance with law. 7. In view of the aforesaid submissions, without expressing any opinion on the merits, with the consent of both the counsel, writ petition is disposed at admission stage by directing respondent No.4 to consider and pass appropriate orders pursuant to the representation dated 25.02.2025 made by the petitioner within a period of four (04) weeks in accordance with law. 8. Accordingly, the Writ Petition stands disposed of. There shall be no order as to costs.
