Mr. Siddhartha Bisht, AGA for the State. Hon’ble Ravindra Maithani, J. (Oral) Applicant Nandu is in judicial custody in FIR No. 27 of 2023, under Sections 420, 467, 468, 471, 504 and 120B IPC, Police Station Narendra Nagar, District Tehri Garhwal. He has sought his release on bail. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, the applicant had sold the property in excess to his share and by doing so, had also sold the property of the informant to Rajendra Singh Bhandari. 4. Learned counsel for the applicant would submit that the sale with Rajendra Singh Bhandari had never been completed; the applicant had filed a suit for cancellation of sale deed; meanwhile, Rajendra Singh Bhandari had sold the property in favour of some other person, in whose favour 2 the informant had already executed a sale deed in respect to property in question, prior to lodging of the FIR. 5. These facts are not denied by the learned State Counsel. It makes out a case for bail. 6. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 7. The bail application is allowed. 8. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
