Heard Sri. Narayana Bhat.M., learned counsel for the petitioner and Sri. B.L.Sanjeev, learned counsel for respondent Nos.1 to 3. Perused the writ petition papers. 3. Learned counsel Sri. M.Narayana Bhat for the petitioner would submit that the petitioner retired from service on attaining the age of superannuation on 31.10.2024 from the respondent-KPTCL. It is submitted that on retirement, the respondents are obliged to settle pension and pensionary benefits of the petitioner. But till this date, the respondents have failed to settle pension and pensionary benefits of the petitioner. He submits that in that regard, the petitioner submitted representations at Annexure-D dated 06.11.2024 and Annexure-E dated 23.12.2024, which are pending consideration. - 4 - NC: 2025:KHC:3167 WP No. 1353 of 2025 4. Per contra, learned counsel Sri. B.L.Sanjeev would submit that the representations of the petitioner would be considered in accordance with law, within a reasonable time. 5. As per Annexure-A1, it is seen that the petitioner on his retirement, was relieved from his duties on 30.10.2024. On his retirement, the respondents are legally obliged to settle the petitioner's pensionary benefits subject to the provisions of Karnataka Electricity Board Employees' Service Regulations, 1996. As the respondents have failed to settle the petitioner's pension and pensionary benefits by considering his representations at Annexure-D and E, the petitioner would be entitled for a writ of mandamus. Hence, the following: ORDER (a) Respondent Nos.1 to 3 are directed to consider the petitioner's representations at Annexure-D dated 06.11.2024 and Annexure-E dated 23.12.2024 and pass appropriate order to settle his pension and pensionary benefits in - 5 - NC: 2025:KHC:3167 WP No. 1353 of 2025 accordance with Service Regulations, within a period of two months from today.
