ORDER
Heard Sri V.Nitesh, learned counsel for the petitioner, Sri P.Ajay Babu, learned Assistant Government Pleader for General Administration for Respondents 1,2 & 5 and the learned Assistant Government Pleader for Civil Supplies Administration for Respondents 3 & 4. Notice in respect of 6th respondent is dispensed with, since no order affecting his right is passed.
2. The above Writ Petition is filed to direct the official respondents not to furnish the petitioner’s service record particulars to the 6th respondent in
pursuance of application made by 6th respondent on 01.11.2024 under Right to Information Act, as the same is against the order of the Hon’ble Apex Court in SLP (Civil) No.27734 of 2012 dated 03.10.2012.
3. Today when the matter is listed, Sri P.Ajay Kumar, learned Assistant Government Pleader for General Administration submitted the written instructions of the 5th respondent-Tahsildar. A perusal of the instructions would disclose that the information sought by the 6th respondent is personal information of the petitioner and Section 8 (1) (j) of the Right to Information Act protects personal information from disclosure unless the public interest justifies it. Learned Assistant Government Pleader would submit that the 5th respondent will pass appropriate orders keeping in view of Section 8 (1) (j) of the Right to Information Act as well as order of the Hon’ble Apex Court in SLP (Civil) No.27734 of 2012 dated 03.10.2012.
4. Given the facts and circumstances of the case, the Writ Petition is
disposed of at the stage of admission with the consent of learned counsel on either side directing the 5th respondent to pass appropriate orders keeping in view of Section 8 (1) (j) of the Right to Information Act as well as order of the Hon’ble Apex Court in SLP (Civil) No.27734 of 2012 dated 03.10.2012. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
