JUSTICE VINOD KUMAR BHARWANI Order 30/07/2025 The matter has come up on an application No.1/2025 filed by the petitioners under Article 227 of the Constitution of India r/w Section 151 of C.P.C., praying therein that the present writ petition may be converted into a Civil Misc. Appeal. In the aforesaid application, it is pleaded that there is a provision in the C.P.C. and C.C.A. for filing an appeal against the rejection order of the application under Order 9 Rule 13 of C.P.C. and in this regard an issue has also been raised by opposite counsel. Heard. Perused. For the reasons & grounds stated therein, the application is allowed. The present writ petition be treated/registered as Civil Misc. Appeal. Office to proceed further.
