This petition has been filed challenging the order dated 26.8.2015 by which the application for temporary injunction in a suit was rejected by the trial court. The misc. appeal filed by the plaintiff under Order 43 Rule 1(r) C.P.C. was also dismissed. 3. It has been admitted to both the parties that original suit from which this petition arises has already been dismissed on 25.09.2024. 4. It has been contended by learned counsel for the petitioner that appeal has been filed against the decree dismissing the suit. 5. Be as it may. The present petition does not survive as the suit in which the order was passed has already been dismissed. 6. The petition rendered infructuous and is dismissed as infructuous.
