The petitioner should implead Nagar Panchayat, Kadipur, Tehsil-Kadipur, District-Sultanpur through the Executive Officer as opposite party No.6 during course of the day. 3. The petitioner is aggrieved by alleged encroachment on his land bearing Gata No.264 in respect of which he claims to be a recorded tenure holder, by the opposite party No.4 for constructing a park. Counsel for the opposite party No.4 says that the land of the petitioner is bounded by a wall and has not been encroached. Let the petitioner initiate proceedings for demarcation under Section 24 of the U.P. Revenue Code, 2006 or such other provisions as may be applicable and based on the result of inquiry, if some land of his gata has been encroached by opposite party No.4 then he can take remedial measures against the opposite party No.4. If such an application is filed as per law then the same shall be decided keeping in mind the statutory period prescribed in law unless there is any legal impediment. 4.
