Also heard Mr. K K Parasar, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This application has been filed under Section 483 of the BNSS, 2023, whereby the petitioner Ismail Hossain has prayed for releasing him on bail, after he was arrested in connection with Mangaldoi P.S. Case No. 84/2025. Page No.# 2/2 3. The petitioner and the informant were known to each other through Facebook. The petitioner showed interest in Hindu religious matters. Therefore, the informant asked the petitioner why he does not accept Hinduism. In reply to the answer, the petitioner used parliamentary words against the informant saying that she is a prostitute. Therefore, the informant has lodged the FIR stating the aforesaid fact. 4. Mr. Parasar has submitted that the petitioner is a 60 year old man and such an act cannot be accepted from the person like the petitioner. 5. I have considered the submissions made by the learned counsel of both sides. 6. The petitioner is languishing in jail since 16.05.2025. 7. This Court is of the opinion that the petitioner does not deserve to be detained in custody for the allegation brought against him. 8. Therefore, the bail application of the petitioner is allowed. 9. It is hereby directed that the petitioner Ismail Hossain, who was arrested in connection with Mangaldoi P.S. Case No. 84/2025, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of learned Chief Judicial Magistrate, Darrang, Mangaldoi. The bail application is disposed of accordingly. The CD shall be returned. JUDGE Comparing Assistant
