(Oral) Applicant Lakhvinder Singh is in judicial custody in FIR No. 163 of 2023, under Sections 363, 366 & 376(2)(n) IPC and Sections 5 & 6 of the Protection of Children from Sexual Offences Act, 2012, Police Station Gadarpur, District Udham Singh Nagar. He has sought his release on bail. 2. This is second bail application of the applicant. His first bail application has been dismissed as withdrawn on 01.07.2024. 3. Heard learned counsel for the parties and perused the record. 4. According to the FIR, the victim, a young girl, left her home on 16.07.2023 at 04:00 in the morning and thereafter she was not traceable. It was the prosecution case that she went along with the applicant. 5. Learned counsel for the applicant would submit that the applicant and the victim both were in romantic relationship; they were talking to each other and on 16.07.2023, she willingly left her home and joined the company of the applicant. He has referred to the statement of the victim. 2 6. These facts are not disputed by the learned State Counsel. 7. Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 8. The bail application is allowed. 9. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
