Hon'ble Om Prakash Shukla,J. Heard. The petitioner's contention is that he has purchased a Tata Motor's Goods Carrier bearing No.UP 36 T 4678 from Sri Zaheer Alam Nadvi. Possibly, the said truck was used by Sri Nadvi for transportation of minerals and a Minetag was generated in respect of the said truck prior to it's purchase by the petitioner. When the petitioner purchased it, the vehicle did not bear the Minetag and the petitioner was unaware of it. Subsequently, he received challans from District Chitrakoot, Kaushambhi for violations pertaining to transportation of minerals with reference to the Minetag. It is only then the petitioner came to know about it. He says that the Minetag is being used in respect of a dumper, whereas, the petitioner has purchased a different type of vehicle. He says that wherever the dumper will be taken, the challan would be generated if there is illegal transportation of mineral, therefore, he cannot possibly approach each and every authority after the challans are generated, as same may span over many districts. In these circumstances, the petitioner has approached the opposite party No.2. Let the opposite party No.2 get an inquiry conducted on the application of the petitioner and ascertain the correct facts. If he finds that the assertions of the petitioner are correct, then he shall ensure appropriate remedial action so that the petitioner is not harassed unnecessarily and the Minetag is also cancelled if it is possible to do so, however, if the factual position is otherwise, then he shall communicate the same to the petitioner and to the concerned authority.
