The present Application has been filed by the applicant for regular bail in connection with the Case Crime No. 367 of 2024, registered at police station Ramnagar, District Nainital. 2. The applicant Jitendra Singh Bora is in judicial custody for the offence under Section 8 read Section 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 3. As per the First Information Report, the police party apprehended the applicant on 13.12.2024. 2025:UHC:615 2 On suspicion, he was searched. The police party had recovered 450 grams of charas from his possession. 4. Heard Ms. Medha Pande, learned counsel for the applicant and Mr. S.C. Dumka, learned A.G.A. for the State. 5. Ms. Medha Pande, Advocate, has contended that the applicant has been falsely implicated in the present matter. Nothing was recovered from his possession. The alleged recovery was planted. The alleged recovered contraband is below the commercial quantity. Applicant does not have any criminal antecedents. He is a permanent resident of District Almora, therefore, there is no likelihood of his absconding, and, he is in judicial custody since 14.12.2024. 6. Mr. S.C. Dumka, learned A.G.A. has opposed the bail application orally. 6. 7. Having considered the submissions of learned counsel for both the parties and in the facts and circumstances of the case, without expressing any opinion as to the merit of the case, this Court is of the view that the applicant deserves bail at this stage. 8.
