Neutral Citation No. - 2025:AHC-LKO:22004 Court No. - 18 Case :- WRIT - A No. - 3895 of 2025 Petitioner :- Sunita Singh Alias Sunita Devi Respondent :- Director, Bal Vikas Seva Evam Pushtahar U.P. Lko. And 4 Others Counsel for Petitioner :- Ram Kewal Tripathi Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. 1.Heard learned counsel for the petitioner(s) and learned Standing Counsel who has accepted notice on behalf of respondents. 2.By means of this writ petition, the petitioner has prayed for issuance of a writ of certiorari quashing impugned order dated 1.3.2025, passed by respondent No.2 whereby promotion of the petitioner on the post of Anganwadi Karyakatri has been rejected, with a further prayer to direct the respondents to promote the petitioner on the post of Anganwadi Karyakatri from the post of Anganwadi Sahayika at Aganwadi Centre, Ratanpur, district Balrampur. 3.It is submitted on behalf of the petitioner that the petitioner is working on the post of Anganwari Sahayika and is fully eligible and qualified for being promoted on the post of Anganwari Karyakatri. The petitioner belongs to general category and the post in question at Anganbari Centre Ratanpur is also a general category post. However, it has been wrongly shown as a reserved post by District Programme Officer. 4.Learned standing counsel on the basis of written instructions, which are taken on record, submits that pursuant to the direction issued by
the State Government, earlier reservation of the entire district Balrampur has been reviewed by a committee, as a result of which, the post in question at Ratanpur has been changed from general category to reserved category. It is submitted that the petitioner has not challenged the reservation. The selection for the post in question was completed on 9.2.2024 and till that date, there was no claim of the petitioner. It is only on 23.8.2024 and 29.8.2024, demand of promotion has been made by the petitioner. The petition is mis-conceived and there is no illegality in the impugned order dated 1.3.2025. 5. I have considered the submission(s and perused the record.
A perusal of the written instructions, it appears that a State level drive was conducted in the year 2021 on the instructions of the Principal Secretary of the Department of Bal Vikas Seva and Pushtahar, U.P. Lucknow and reservation of entire State was reviewed, in which the post in question at Ratanpur has also been reviewed and after doing this exercise, the reservation of the post has been changed from general category to reserved category, i.e. SC/ST. There appears to be no illegality in the impugned order, more so when the petitioner has not challenged the reservation of the post in question. 6.The petition lacking merit is dismissed.
