Neutral Citation No. - 2025:AHC-LKO:21962 Court No. - 18 Case :- WRIT - A No. - 3889 of 2025 Petitioner :- Smt. Rakhee Devi Respondent :- State Of U.P. Thru. Prin. Secy. Child Development Services And Nutrition Lko. And 6 Others Counsel for Petitioner :- Anil Mishra,Vineet Kumar Verma Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner(s) and learned Standing Counsel who has accepted notice on behalf of respondents 1 to 6. By means of this writ petition, the petitioner has prayed for issuance of a writ of certiorari quashing appointment of respondent No.7 on the post of Anganwadi worker and further a mandamus directing respondents to consider the application of the petitioner for the post of Anganwadi worker and issue an appointment letter in favour of the petitioner. Learned standing counsel, on the basis of written instructions which are taken on record, has submitted that as per government order dated 21.3.2023, merit list has to be prepared for the post of Anganbari Karyakatri on the basis of educational qualification of the incumbents, i.e. minimum Intermediate and maximum is post- graduation. The marks in the High School examination are not to be considered. He submits that as per written instructions, the private respondent has obtained 19.98 marks and has come on top of the select list whereas the petitioner has secured 19.8 marks and has come on just below the private respondent. Thus, being higher in merit, the private respondent has been
selected. There appears to be no illegality in non-selection of the petitioner as the selection of private respondent has been done on the basis of her having secured higher marks than the petitioner. The petition lacks merit and is accordingly dismissed. Order Date :- 18.4.2025 kkb/ Digitally signed by :- KRISHNA KUMAR BARANWAL High Court of Judicature at Allahabad, Lucknow Bench
