Also heard Mr. K. K. Das, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 praying for grant of bail to the petitioner, who were arrested in connection with Dharamtul P. S. Case No.22/2025. 3. Mr. Das, learned Additional Public Prosecutor has objected to this bail application. 4. One person has lodged an FIR before Police alleging that in Shiva Dhaba, which is owned by the petitioner Ananta Bora, was frequented by different couples, where the said couple had indulged in acts, which were not socially accepted. The Dhaba also allegedly sold liquor. After getting the information, the petitioner Ananta Bora, who is the owner of the said Dhaba and the cook Dhrubjyoti Bhuiyan and 2(two) other young person got arrested, while police arrived there. Page No.# 3/3 5. I have considered the submission made by learned counsel for both the sides. 6. It appears that it was a case of moral policing only. The petitioners are in custody since 09.05.2025. 7. This Court is of the opinion that the petitioners no longer deserves to be detained in custody. 8. Therefore, the bail application of petitioners is allowed. 9. The petitioners, 1. Ananta Bora, 2. Dhurba Jyoti Bhuyan, 3. Hedayat Ullah and 4. Rafikul Islam, who were arrested in connection with Dharamtul P. S. Case No.22/2025 shall be released on bail of Rs.20,000/- each with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Morigaon. 10.
