BEFORE HONOURABLE MR. JUSTICE SANJAY KUMAR MEDHI ORDER 27.08.2025 Heard Shri D. Hajong, learned counsel for the petitioner. Also heard Shri N. Goswami, learned State Counsel and Shri B. Sarma, learned counsel for the Railways. Pursuant to the last order dated 18.07.2025, Shri Goswami, learned State Counsel has placed before this Court copy of the Final Report (FR) pertaining to the Latasil PS Case No. 161/2017 under Section 365 of the IPC. Perused the same. The learned counsel for the petitioner has submitted that till date, his client has not received any notice from the concerned Court. In this connection, it would be pertinent to take none of the reliefs prayed in this writ petition, which read as follows:
“In view of the facts and circumstances of this petition, the petitioner prays that the Learned Court may graciously be pleased: i. To monitor the investigation made by the respondents in pursuance of the complaint lodged by the petitioner; and
Page No.# 3/3 ii. to issue any other such writ/orders/directions as this learned Court may deem fit.
-AND- Pending disposal of the application, this Hon’ble Court may be pleased to pass the following interim order: i. To submit a status report regarding the investigation made in pursuance of the complaint lodged by the petitioner.” Considering the above, this Court is of the opinion that the writ petition can be disposed of by directing the learned State Counsel to furnish a copy of the FR to the learned counsel for the petitioner so that the proper course of law can be availed by the petitioner, if so advised. The writ petition accordingly stands closed. A copy of the FR is made a part of the records. JUDGE Comparing Assistant
