The writ petition is disposed of with a direction that in case the petitioner has any grievance with regard to section invoked in the case, he is at liberty to file an application in view of judgement of Hon'ble Supreme Court in Sakiri Vasu vs. State of U.P. and others, (2008) 2 SCC 469, which shall be decided by the Magistrate concerned expeditiously as early as possible.
