Regional Passport Officer, Dehradun informed the petitioner vide email dated 20.06.2024 that his police verification report is adverse and he was asked to visit regional passport office by taking online appointment for clarification. Thus, feeling aggrieved by email dated 20.06.2024, petitioner has approached this Court. 3. Learned counsel for petitioner admits that an FIR was registered against the petitioner and concerned Magistrate had summoned the petitioner by order dated 26.03.2021; petitioner challenged the summoning order in a petition filed under Section 482 CrPC and learned Single Judge of this Court vide order dated 26.03.2021 stayed the summoning order. He thus submits that passport cannot be denied to the petitioner merely because an FIR has been registered against him. 4. In support of his contention that a passport cannot be denied on account of pendency of criminal proceeding, he relies upon judgment rendered by Division Bench of Hon’ble Allahabad High Court (Lucknow Bench) in the case of Umapati Vs. Union 2025:UHC:7321 of India through Secretary Ministry of External Affairs, decided on 25.06.2024 in WRIT-C No. 5587 of 2024. He also relies upon judgment rendered by Hon’ble Supreme Court in the case of Vangala Kasturi Rangacharyulu Vs. Central Bureau of Investigation reported in 2021 SCC OnLine SC 3549. 5. Learned counsel appearing for Regional Passport Office, however, submits that petitioner was given an opportunity vide email dated 20.06.2024 to have a say in the matter and without responding to said email, he rushed to this Court. He submits that if petitioner has any grievance, he can make a representation to the Regional Passport Office. 6. This Court finds substance in the submission made by Mr. Pankaj Chaturvedi, learned counsel appearing for respondent/Regional Passport Office. 7. The writ petition is, therefore, disposed of with liberty to petitioner to make representation to the Passport Officer, Regional Passport Office, Dehradun. In the representation, petitioner may make all submissions, including law on the point as declared by Hon’ble Supreme Court and other constitutional Courts. If petitioner makes such representation within ten days from today, the concerned authority shall take decision thereupon within four weeks thereafter.
