Neutral Citation No. - 2025:AHC-LKO:19617 Court No. - 18 Case :- WRIT - A No. - 3790 of 2025 Petitioner :- Suchi Mishra Respondent :- State Of U.P. Thru. Its Prin. Secy. Bal Vikas Seva Evam Pushtahar Vibhag And 4 Others Counsel for Petitioner :- Shesh Mani,Komal Prasad Tiwari Counsel for Respondent :- C.S.C. Hon'ble Karunesh Singh Pawar,J. 1. In view of the proposed order being passed, notices to respondent No.5 is dispensed with. 2. Heard learned counsel for the petitioner and learned A.C.S.C. for the State-respondent No.1 to 4. 3. By this petition, the petitioner has challenged the selection of respondent No.5 on the post of Anganwadi Karyakarti with a further prayer to issue a writ of Mandamus commanding the respondents to appoint the petitioner on the said post. 4. Learned Standing Counsel on the basis of the written instructions has submitted that the respondent No.5 Sudha Devi comes under the category of Below Poverty Line and since the application of none of the applicants who have applied for the post of Anganwadi Karyakarti come under the category of Widow therefore, as per the Government Order dated 21.03.2023 the candidate of Below Poverty Line has been given preference. He has also submitted that the private respondent No.5 is having income of Rs.42,000/- per annum which comes under the category of Below Poverty Line however, the petitioner's income is Rs.48,000/- per annum which comes under the category of Above Poverty Line and on this ground, the petitioner could not be selected. 5. Perused the record so also the written instructions submitted by learned Standing Counsel which are taken on record. 6. A perusal of the Government Order dated 21.03.2023 as also the written instructions submitted by learned Standing Counsel show that the petitioner comes under the category of Above Poverty Line whereas the selected candidate i.e. the respondent No.5 comes under the category of Below Poverty Line whose income is Rs.42,000/- per annum as against the petitioner who is Above Poverty Line and therefore, in terms of the Government Order dated 23.01.2023, the petitioner could not be selected hence, I find no illegality in the selection of the respondent No.5. It is in conformity with the policy of the State in view of the Government Order dated 21.032.2023 and, therefore, the writ petition lacks merits and is accordingly dismissed.
