Neutral Citation No. - 2025:AHC-LKO:44805 Court No. - 14 Case :- CRIMINAL MISC. ANTICIPATORY BAIL APPLICATION U/S 482 BNSS No. - 296 of 2025 Applicant :- Ramu Opposite Party :- State Of U.P. Thru. Prin. Secy. Deptt. Of Home Lko And Another Counsel for Applicant :- Panna Lal Gupta,Himanshu Singh,Rishabh Tiwari,Subrat Gupta Counsel for Opposite Party :- G.A.,Kaushal Kishore Tewari Hon'ble Karunesh Singh Pawar,J. Heard learned counsel the applicant, learned A.G.A. for the State and Shri Kaushal Kishore Tewari, learned counsel for the complainant. The present application under Section 438 Cr.P.C./482 B.N.S.S. has been filed seeking anticipatory bail in FIR/Case Crime No. 192 of 2024, under Sections 420,467,468,471,406,504,506 IPC, P.S. Itaunja, District Lucknow.
Learned counsel for the complainant submits that the interim bail was granted to the applicant upon the undertaking given by him that the remaining amount shall be returned to the complainant. The entire amount has been taken by the applicant from the complainant in his bank account. The applicant after being released on interim bail on the basis of the said undertaking has not fulfilled that undertaking. Learned A.G.A., on the basis of the record, submits that the applicant has taken a total amount of Rs. 48 lakhs approximately. Perused the record. A perusal of the record shows that the applicant and his wife had taken money on the pretext of providing job. A forged joining letter and merit list was provided by them. The joining letter given by the applicant to the brother and the cousin brother of the complainant has been found forged. From the FIR, it is evident that the complainant, his brother, sister as well as cousin brother have given most of their money to the tune of Rs. 26,71,000/- approximately online in the account of the present applicant. The bank statement is enclosed with the FIR.
The investigation is going on. Thus, it appears to be a case of custodial interrogation. Even otherwise, it does not appear to be a case of false implication or the applicant has been implicated in order to injure his reputation. In view of the above, no ground for grant of anticipatory bail is made out. Accordingly, the anticipatory bail application is rejected. Consequently, the interim order granted earlier is cancelled.
