No.3710 OF 2025 THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.3710 OF 2025 ORDER: 1. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The learned counsel submits that the petitioner was arraigned as A.3 in C.C. No.1328 of 2023 on the file of the Additional Judicial Magistrate of First Class, Kadiri, for the alleged offence under Section 7(1)(a) of the Essential Commodities Act, 1955. It is alleged in the complaint that the petitioner was involved in the transport of PDS rice. 3. The learned counsel for the petitioner submits that in the charge sheet, it was mentioned that the petitioner was the owner of the rice mill and had purchased the PDS rice. However, the petitioner was neither present at the location of the crime nor is in any way related to A.1 and A.2. 4. The learned counsel relies on the judgment of this Court rendered in Crl.P.No.1625 of 2022, wherein, under identical circumstances, this Court quashed the case against the petitioner. 5. Similarly, in the present case, the learned counsel submits that there are no ingredients present in the charge sheet that would attract Section 7 of the Essential Commodities Act. 3 CRL.P. No.3710 OF 2025 6. Considering the submissions, the proceedings in C.C. No.1328 of 2023 on the file of the Additional Judicial Magistrate First Class, Kadiri, against the petitioner, are hereby quashed. 7. Accordingly, the criminal petition is allowed. 8.
