The present petition has been filed for the following main relief:- "(i) Directing the opposite party no. 1 to expeditiously decide the Case No. 3398/2024, Computerized case no. T202402570403398, (Chandra Kant versus Bhola Prasad) filed under section 34 of Uttar Pradesh Revenue Code, 2006 within the stipulated time which is pending before the opposite party no. 1 since 30.05.2024, in the interest of justice." Considered the note dated 07.05.2024 of the Tehsildar Patti, Pratapgarh, on the application of the petitioner dated 23.04.2024, according to which the case under Section 34 of U.P. Land Revenue Act, 1901, was not instituted. After considering the aforesaid on being confronted, learned Counsel for the petitioner says that he may be permitted to withdraw the present petition with liberty to file a fresh with proper pleadings and documents including the order by which the cases i.e. Case No. 3398/2024, Computerized Case No. T202402570403398, Case No. T20220257040338 and other connected cases, were clubbed. To the aforesaid prayer, learned Standing Counsel has no objection. Accordingly, the present petition is dismissed as withdrawn with liberty as aforesaid. Office is directed to return back all the certified/original copies of order and documents, annexed in the present petition, to the learned Counsel for the petitioner, if he applies for the and submit the copies of same.
