Some application had been filed by the petitioner before the Sub-Divisional Magistrate seeking some enquiry on which some report has been sought by the Sub-Divisional Magistrate on 17.01.2025. As the S.D.M. is already seized with the matter, therefore, we see no reason to proceed any further except to direct the S.D.M. concerned to take whatever decision is required to be taken on the application provided it is maintainable, as per law. The private opposite parties shall also be heard before taking such decision, as it is their claim that the tenure holder having rights of a Bhoomidhar with non-transferable rights could not sell the land in question. The writ petition is disposed of accordingly.
