(Oral) By means of instant writ petition, the petitioner seeks following reliefs:- (i) Issue a writ, order or direction in the nature of mandamus directing and commanding the respondent nos.3 and the respondent no.4 to take immediate steps for declaring the result of selection process initiated by the respondent no.4 for the post of Assistant Teacher in terms of mandate of Regulation 17 (Gha) of Uttarakhand School Education Board Regulations 2009. (ii) Issue any other or further writ, order or direction which this Hon’ble Court may deem fit and proper in the circumstances of the case. (iii) To award the cost of the petition in favour of the petitioner. 2 2. Heard learned counsel for the parties and perused the record. 3. Learned counsel for the petitioner would submit that the Assistant Teacher was to be appointed in Adams Girls Inter College, Almora for which all the formalities have already been conducted and it was sent for approval to the respondent no.3, the Chief Education Officer, Almora, but he has not taken any decision on it within a stipulated time as contemplated in the Uttrakhand Regulations for Selection of Teachers and Non-Teaching Staff of Non-Government Recognized Institution recognized by the Uttarakhand School Education Board Regulations, 2009. 4. The Court wanted to know from learned State counsel on 09.10.2024 as to why it has not been done? 5. He had no reply. Therefore, yesterday, the Court requested the Chief Education Officer, Almora to join the proceedings. 6. Mr. Atresh Sayana, District Education Officer and holding charge of the Chief Education Officer, Almora joined the proceedings. He would submit that there are some discrepancies in the procedure that was followed for recruitment. Therefore, decision could not be taken. He informs the Court that within two weeks from now, a decision on the matter shall be taken on it. 3 7. The Court takes on record the statement given the Chief Education Officer, Almora. 8.
