Ms. Mamta Bisht, learned counsel for respondent No.3. 4. Delay in filing the short counter affidavit is condoned. Short counter affidavit filed by the State is taken on record. Delay condonation application (IA/1/2025) made therefor, is allowed. 5. By means of the present criminal writ petition, petitioner has challenged the FIR No.241 of 2024 dated 20.07.2024 registered with Police Station Vikas Nagar, District Dehradun under Section 376 of IPC. 6. It is contended by the learned State Counsel in short counter affidavit that after investigation, charge-sheet has already been filed by the police on 12.09.2024 against the petitioner, therefore, nothing remains to be decided in this writ petition and it becomes infructuous. 7. The said fact is not disputed by learned counsel for the petitioner. 8. In view of the statement made by learned State Counsel, the present criminal writ petition is dismissed as infructuous. However, a liberty is given to petitioner to challenge the charge-sheet in appropriate proceedings, before the appropriate forum. (Pankaj Purohit, J.) 20.03.2025 PN
