Court No. - 5 Case :- WRIT - A No. - 1288 of 2025 Petitioner :- Ram Murti Tiwari Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Pradeep Verma Counsel for Respondent :- Harshit Pandey,C.S.C. Hon'ble Ajay Bhanot,J. Heard Shri Pradeep Verma, learned counsel for the petitioner, Shri Harshit Pandey, learned counsel for the respondent and learned Standing Counsel for the State. The petitioner claims various entitlements including Assured Career Progression (A.C.P.) benefits, retiral dues, gratuity and part of pension which has not been disbursed. He has made a representation in this regard but to no avail. Learned Standing Counsel for the State and Shri Harshit Pandey, learned counsel for the respondents submit that the matter requires determination of facts by the competent authority as per law in the first instance. However, they fairly contend that service benefit/claim is liable to be decided by the competent authority in a reasonable time frame. In light of the aforesaid submissions and without going into the merits of the case, the respondent authority shall decide the representation of the petitioner regarding grant of Assured Career Progression (A.C.P.), retiral dues, gratuity and part of pension as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of. Order Date :- 24.2.2025 Vandit Digitally signed by :- VANDIT AGRAWAL High Court of Judicature at Allahabad
