PUBLIC PROSECUTOR The Court made the following Order: ...RESPONDENT/COMPLAINANT This Criminal Petition under Sections 480 and 483 of BNSS been filed by the petitioner herein/A2 seeking regular bail in Crime No.17 of 2024 of Pedabayalu Police Station, Alluri Sitharama District, registered for the offences punishable 20(b)(ii)(B) read with 8(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985. Case of the prosecution, in brief is that on 03.04.2024, Election duties, the flying squad in-charge of Dy.Tahsildar, along with his staff conducting vehicle checking and caught the accused in possession of 11.660 Kgs of Ganja. Learned counsel for the petitioner contends that the petitioner has
3. been in judicial custody from 01.03.2025 and prays this Court to grant bail to the petitioner herein.
4. On the other hand, learned Assistant Public Prosecutor vehemently opposed the grant of bail to the petitioner. Heard. Perused the record.

Learned counsel for the petitioner submitted that the contraband
6. alleged to be seized from the possession of accused is 11.660 Kgs of ganja, which is not of commercial quantity. It is submitted that the petitioner had permanent abode and there is no possibility of his fleeing away from the justice. It is submitted by the learned counsel for the petitioner that most of the witnesses are shown to be official witnesses and the release of the accused would not cause hampering of investigation and tampering of witnesses.
7. In view of the aforesaid facts and circumstances of the case and since the contraband involved in the present crime is not a commercial quantity, this Court is inclined to grant bail to the petitioner herein.
8. In the result, the criminal petition is allowed with the following conditions: i. The petitioner herein shall be released on bail on his executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the learned
3 Additional District & Sessions Judge-cum-Special Judge for Trail of the cases under the NDPS Act, 1985, Visakhapatnam. ii. On release, the petitioner shall appear before the Station House Officer concerned, once in a fortnight i.e., on 1st and 15th of every month between 10.00 AM and 01.00 PM., for a period of three (3) months. iii. The petitioner shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses.
